Terms of Service

These Terms of Service ("Terms") govern your use of the TalkBook AI voice receptionist service operated by TalkBook Technologies Pvt. Ltd. ("TalkBook," "we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.
1. Service Description
TalkBook provides an AI-powered voice receptionist service that:
- Answers incoming phone calls on behalf of your business
- Handles appointment booking, rescheduling, and cancellations
- Responds to frequently asked questions about your business
- Provides call transcripts, analytics, and real-time notifications
- Integrates with your existing phone number via call forwarding
The service is provided "as is" and we continuously work to improve accuracy and capabilities. While our AI achieves high accuracy rates, it is not infallible and may occasionally misinterpret caller intent.
2. Account Terms
- You must be at least 18 years old to use this service
- You must provide accurate, complete, and current registration information
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- One person or business entity may not maintain more than one free trial account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
3. Payment Terms
- Subscription model: TalkBook operates on a monthly subscription basis. Plans are billed monthly in Indian Rupees (INR).
- Free trial: New accounts receive a 14-day free trial with full features. No credit card is required to start the trial.
- Auto-renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
- Payment methods: We accept UPI, credit/debit cards, net banking, and other payment methods available through our payment processor.
- Price changes: We may change subscription prices with 30 days advance notice. Price changes will apply at the start of your next billing cycle.
- Taxes: All prices are exclusive of applicable GST and other taxes, which will be added to your invoice as required by law.
- Failed payments: If a payment fails, we will attempt to charge your payment method up to 3 times. After 3 failed attempts, your account may be downgraded or suspended.
4. Cancellation Policy
- Cancel anytime: You may cancel your subscription at any time through your account dashboard or by contacting support.
- Effective date: Cancellation takes effect at the end of your current billing period. You will continue to have access to the service until then.
- No refunds: We do not provide prorated refunds for unused portions of a billing period. However, if you cancel within the first 7 days of a new billing cycle, you may request a full refund for that cycle.
- Data retention: After cancellation, your data will be retained for 30 days to allow for reactivation. After 30 days, your data will be permanently deleted.
- Reactivation: You may reactivate your account within 30 days of cancellation without losing your configuration data.
5. Acceptable Use
You agree NOT to use TalkBook to:
- Engage in any unlawful, harassing, or fraudulent activity
- Impersonate another person or entity
- Transmit spam, unsolicited communications, or promotional material
- Violate any applicable local, state, national, or international law
- Collect or store personal data of callers for purposes not disclosed to them
- Interfere with or disrupt the service or servers connected to the service
- Attempt to gain unauthorized access to any part of the service
- Use the service for any purpose that is illegal under Indian law
- Resell, sublicense, or redistribute the service without our written consent
Violation of acceptable use terms may result in immediate account suspension or termination without refund.
6. Intellectual Property
The TalkBook service, including its AI models, software, website, branding, and documentation, is owned by TalkBook Technologies Pvt. Ltd. and protected by intellectual property laws. You retain ownership of your business data and content provided to configure the service.
You grant us a limited, non-exclusive license to use your business information solely for the purpose of providing the service. We may use anonymized, aggregated data to improve our AI models and service quality.
7. Limitation of Liability
To the maximum extent permitted by applicable law:
- TalkBook shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
- Our total liability for any claims relating to the service shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for missed calls, incorrect information provided by the AI, or failed appointment bookings
- We are not responsible for third-party service outages (telecom providers, cloud infrastructure) that may affect service availability
You acknowledge that the AI system, while highly accurate, is not perfect and should not be the sole point of contact for emergency or critical communications.
8. Indemnification
You agree to indemnify and hold harmless TalkBook Technologies Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.
9. Service Availability
We strive to maintain 99.9% uptime for our service. However, we reserve the right to temporarily suspend the service for maintenance, updates, or due to circumstances beyond our control. We will provide advance notice of scheduled maintenance whenever possible.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the use of our service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If negotiation fails, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on our website at least 30 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the modified Terms.
